A BILL FOR AN ACT


 

 

RELATING TO THE BOARD OF REGENTS OF THE UNIVERSITY OF HAWAII.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 304A-105, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The board of regents shall develop internal policies and procedures for the procurement of goods, services, and construction, consistent with the goals of public accountability and public procurement practices, but not subject to chapter 103D.  Notwithstanding any other law to the contrary, chapter 103D shall not apply to procurement actions or activities undertaken, conducted, or performed under the authority of the board of regents or the University of Hawaii.  However, where possible, the board of regents is encouraged to use the provisions of chapter 103D; provided that the use of one or more provisions of chapter 103D shall not:

     (1)  Constitute a waiver of the exemption from chapter 103D; and

     (2)  Subject the board to any other provision of chapter 103D.

The board of regents shall file its procurement policy and any changes in the policy with the Hawaii procurement institute."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2020.
