A BILL FOR AN ACT


 

 

RELATING TO AGRICULTURE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State should take the lead in designating "important agricultural land".  By doing so, the legislature hopes that private landowners will follow.

     The purpose of this Act is to designate state agricultural land as "important agricultural land".

     SECTION 2.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§205-    Designation of state agricultural land as "important agricultural land".  (a)  For the purpose of this section, "state agricultural land" means land that is owned by the State and situated within the agricultural district.

     (b)  All state agricultural lands are designated to be "important agricultural land" without necessity of separate identification and designation by the commission under section 205-49(a).  The legislature finds that the designation of each parcel of such land as important agricultural land complies with at least one standard or criterion under section 205-44.

     Upon the effective date of this Act, the commission shall include the land designated under this subsection in the adopted maps of important agricultural land.

     (c)  Upon the effective date of this Act, the reclassification of important agricultural land designated under subsection (b) shall be subject to the standards and criteria of section 205-50."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
