A BILL FOR AN ACT


 

 

RELATING TO HISTORIC PRESERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 59, Session Laws of Hawaii 2003 (Act 59), established the South Kona wilderness area on the island of Hawaii.  The Act authorized the department of land and natural resources to acquire private lands in the area and directed the department to preserve the visual, cultural, and historical aspects of, and to develop a comprehensive management plan for, the South Kona wilderness area.

     Act 59 was subsequently amended by Act 215, Session Laws of Hawaii 2006, to extend the deadline for acquiring these lands to December 30, 2007.

     However, the Legislature finds that more time is necessary to complete the acquisition.  Therefore, the purpose of this Act is to further extend the deadline for acquiring any private lands within the South Kona wilderness area on the island of Hawaii to December 30, 2009.

     SECTION 2.  Act 59, Session Laws of Hawaii 2003, as amended by Act 215, Session Laws of Hawaii 2006, is amended by amending section 4 to read as follows:

     "SECTION 4.  This Act shall take effect on July 1, 2003; provided that:

     (1)  This Act shall be repealed on December 31, [2007,] 2009, if the exchange transactions to acquire the lands described in section 6E-B are not consummated prior to December 31, [2007;] 2009; and

     (2)  In the event that this Act is repealed, any revisions to land classifications that were made pursuant to this Act shall revert to their original classifications."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
