HOUSE RESOLUTION

 

 

REQUESTING A COMPARISON STUDY OF THE BOARD OF REGENTS OF THE UNIVERSITY OF HAWAII AND THE BOARDS OF REGENTS OF SIMILAR STATE UNIVERSITIES ACROSS THE NATION.

 

 

 


     WHEREAS, the University of Hawaii (UH) Board of Regents (BOR) manages and controls the general affairs, and has exclusive jurisdiction over the internal structure, management, and operation of UH, and also serves as the State Board for Career and Technical Education; and

 

     WHEREAS, as part of its powers and as prescribed by sections 304A-105 and 304A-106, Hawaii Revised Statutes, the BOR:

 

     (1)  May purchase or otherwise acquire lands, buildings, appliances, and other property for the purposes of UH, and may expend available funds;

 

     (2)  Shall manage the inventory, equipment, surplus property, and expenditures of UH, and may adopt rules to do so;

 

     (3)  Shall develop internal policies and procedures for the procurement of goods, services, and construction;

 

     (4)  May enter into concession agreements; and

 

     (5)  May receive, manage, and invest moneys or other property that may be given, bequeathed, devised, or otherwise received from sources other than the Legislature or any federal appropriation for the purpose of UH, its improvement or adornment, or the aid or advantage of students or faculty, and in general act as trustee on behalf of UH for these purposes or objects;

 

and

 

     WHEREAS, currently, the BOR is composed of twelve members, including a student member, who are appointed by the Governor and generally serve four-year terms or until their successors have been appointed and have qualified;

 

     WHEREAS, members of the BOR serve without pay but are entitled to expenses for their travel within the state when attending meetings or engaging in business related to the work of the BOR; and

 

     WHEREAS, other state universities across the nation also have boards of regents that govern the affairs of their respective institutions and carry out their specific duties according to their own sets of rules and procedures to achieve their defined missions; and

 

     WHEREAS, it is wise to take a step back from time to time and evaluate one's organization as part of a larger scheme and in comparison with similar organizations, so that one may gain an awareness of ways in which their own organization can be improved, especially when the organization is constantly under scrutiny by the public eye; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the University of Hawaii is requested to perform a comparison study on the powers and responsibilities of the Board of Regents of the University of Hawaii in relation to state statutes and the boards of regents of similar state universities across the nation with the intent of enabling the BOR to:

 

     (1)  Delegate those matters that should be delegated; and

 

     (2)  Retain those matters that meet their fiduciary                 responsibility for the UH; and

 

     BE IT FURTHER RESOLVED that UH is requested to submit a report of its findings and any recommendations to the Legislature no later than 20 days prior to the convening of the Regular Session of 2008;

 

and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the University of Hawaii Board of Regents and President of the University of Hawaii.
