RELATING TO PAIN PATIENT'S BILL OF RIGHTS. Gives rights to pain patients; authorizes prescribing medically necessary controlled substance to treat severe acute or severe chronic pain; allows refusal to prescribe but allows referral of patient to doctors who use opiates for pain management; authorizes board of medical examiners to establish pain management guidelines. RELATING TO HABITUAL OPERATION OF A VEHICLE UNDER THE INFLUENCE OF AN INTOXICANT. Requires habitual DUI offenders to pay a driver education assessment, to be assessed for substance abuse or dependence, and to obtain treatment if necessary. Prohibits issuance of new license to habitual DUI offender until period of license revocation expires. Permits court to order offender to reimburse cost of blood or urine testing. Adds conforming references to habitual DUI offenders to use of intoxicants law. Effective 9/1/04. (SD2) |

Amends appellate jurisdiction of the supreme court and the intermediate appellate court changing the supreme court's jurisdiction to appeals by writ of certiorari or transfer from the intermediate appellate court. Repeals criteria for assigning appeals. Requires most appeals to be filed with the intermediate appellate court instead of the supreme court. Appoints a task force to review the changes and make recommendations for implementation. (SD1) |
