Appropriates emergency funds ($7,417,636) for collective bargaining increases for DOE employees who are members of units 1 & 5.

MAKING AN EMERGENCY APPROPRIATION FOR THE STATE WORKERS' COMPENSATION PROGRAM.

Requires contractors on public works construction contracts to comply with United States Department of Labor specifications for staffing requirements.

RELATING TO PREVAILING WAGES.

Clarifies that the State law requiring payment of prevailing wages applies to all laborers, mechanics, required assistants, helpers, tenders, and apprentices on a public works project, and not only those on the job site.

RELATING TO WAGES AND HOURS ON PUBLIC WORKS.

Requires government contracting agencies to pay assistants, helpers, and tenders wages and overtime compensation from accrued payment withheld under the contract.

Prohibits state contractors and other recipients of state funds from assisting, promoting, or deterring union organizing among its employees.

RELATING TO TAXATION.

Establishes a 5% income tax credit for employers that hire members of the national guard. Establishes that the maximum tax credit per national guard/employee shall be $1,000.

RELATING TO PUBLIC EMPLOYEES.

Establishes that if a public employee's active military pay is less than the public employee's nonmilitary pay, then the public employer shall pay the public employee the difference while on active military duty; provided that the active military duty deployment extends beyond 30 days.

RELATING TO COUNTIES.

Allows Honolulu, Maui, Kauai, and Hawaii counties to make their deferred compensation retirement plan for part-time, temporary, and seasonal or casual public employees mandatory and to participate in the State's existing plan.

SB 2873

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Establishes the employer contributions to the Employees' Retirement System at 15.75 percent of the member's compensation for police and firefighters and 13.75 percent of the member's compensation for all other employees beginning in FY 2005-2006. Eliminates the separate computation of contributions for the Early Incentive Retirement Plan and includes in the total contributions computed as a stated percentage of compensation payment for the remaining amounts due for the Plan as of June 30, 2005.

RELATING TO THE FEDERAL TAX LIMIT ON COMPENSATION APPLICABLE TO THE EMPLOYEES' RETIREMENT SYSTEM.

Applies the federal tax limits on pension compensation effective 7/1/96, and adds a non-tax-qualified arrangement to protect benefits accrued in excess of the federal tax limits for the period 7/1/96, through 6/30/04. Appropriates $357,350 to pay the non-tax-qualified benefits.
