Sir:

Your Committee on Human Services and Housing, to which was referred H.B. No. 2531 entitled:

"A BILL FOR AN ACT RELATING TO INCAPACITATED PERSONS,"

begs leave to report as follows:

The purpose of this bill is to allow:

(1) Any agreement or contract entered into by an incapacitated person to be voidable; and

(2) Any parent, spouse, or guardian of an incapacitated person to petition the court to invalidate the agreement or contract.

Two individuals submitted written testimony in support of this measure.

Your Committee only received written testimony on this measure and as a result, was unable to discuss the issue with testifiers.

Accordingly, your Committee has amended this bill by:

(1) Changing the effective date to July 1, 2020, to promote further discussion; and

(2) Making technical, nonsubstantive amendments for clarity and style.

As affirmed by the record of votes of the members of your Committee on Human Services and Housing that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2531, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2531,

H.D. 1, and be referred to the Committee on Judiciary.
