A BILL FOR AN ACT

 

relating to the state of hawaii.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that this Act is instrumental in reducing costs and facilitating greater efficiency in government. The procedure described in this Act will reduce the size of government while allowing flexibility in retaining positions in critical or priority areas.

SECTION 2. (a) This section shall apply to all positions in the executive branch funded by the general fund. Except as provided in subsection (c):

(1) Thirty per cent of the positions that are vacated after June 30, 2004, and before July 1, 2006, in each department may be refilled by the head of the department to enable the department to carry out its public purpose;

(2) Thirty per cent of the positions:

(A) That are vacated after June 30, 2004, and before July 1, 2005, in each department shall be held vacant during fiscal year 2004-2005 and shall be assigned to a statewide personnel pool administered by the department of human resources development; provided that after June 30, 2005, the governor may propose the transfer of up to fifty per cent of the vacant positions assigned to the statewide personnel pool between executive departments as necessary to fill essential positions, subject to approval by the legislature through the executive budget; and

(B) That are vacated after June 30, 2005, and before July 1, 2006, in each department shall be held vacant during fiscal year 2005-2006 and shall be assigned to a statewide personnel pool administered by the department of human resources development; provided that after June 30, 2006, the governor may propose the transfer of up to fifty per cent of the vacant positions assigned to the statewide personnel pool between executive departments as necessary to fill essential positions, subject to approval by the legislature through the executive budget;

and

(3) Forty per cent of the positions that are vacated in each department shall be eliminated.

(b) Funding allocations for positions vacated pursuant to this Act and refilled pursuant to this section shall be computed on the basis of the position's average monthly salary from the department from which the person separated, and shall be distributed accordingly. All amounts already allocated for positions vacated pursuant to this Act shall be returned to the general fund. Each department shall report its position reallocations to the director of finance, who shall report this information to the legislature no later than twenty days prior to the convening of the regular sessions of 2005 and 2006.

(c) This section shall not apply to positions in the department of education, the University of Hawaii, the Hawaii health systems corporation, the department of commerce and consumer affairs, correctional programs in the department of public safety, and developmental disabilities, adult mental health inpatient, adult mental health outpatient, and child and adolescent mental health programs in the department of health.

SECTION 3. This Act shall take effect on July 1, 2004, and shall be repealed on January 1, 2007.
