RESOLUTION
SUBMITTING TO THE LEGISLATURE OF THE STATE OF HAWAII FOR REVIEW OF ACTION TAKEN BY THE BOARD OF LAND AND NATURAL RESOURCES ON LAND EXCHANGES.
WHEREAS, section 171-50, Hawaii Revised Statutes, provides that land exchanges of public land for private land are subject to disapproval by the Legislature by two-thirds vote of either the Senate or the House of Representatives or by majority vote of both in any regular or special session; and
WHEREAS, Parker Ranch Land Trust owns 4.988 acres of land located at Waimea, South Kohala, Hawaii, identified as Tax Map Key: (3) 6-7-02:portion of 17 and is willing to exchange this land for State-owned land containing .780 acre located at Waimea, South Kohala, Hawaii, identified as Tax Map Key: (3) 6-7-02:portion of 15; and
WHEREAS, the Department of Education requires the Parker Ranch land to expand the Waimea Elementary and Intermediate Schools so that separate campuses can be created; and
WHEREAS, Parker Ranch Land Trust desires the State parcel to allow for realignment of Lindsey Road in order to improve traffic flow through Waimea Town and is therefore willing to forego the difference in land values as no payment is required where the private land exceeds the value of the public land; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004, the Senate concurring, that the following exchange, approved by the Board of Land and Natural Resources (Board), be reviewed by the Legislature:
EXCHANGE OF LAND BETWEEN STATE OF HAWAII AND PARKER RANCH LAND TRUST
Statute: Section 171-50, Hawaii Revised Statutes, as amended.
Purpose: Acquisition of land for public school purposes.
Date of Board Approval: August 8, 2003.
