A BILL FOR AN ACT

 

relating to monopolies; restraint of trade.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 480, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§480- Motion to dismiss, for summary judgment, or for judgment as a matter of law. In any action brought under this chapter, the standards for granting or denying a motion to dismiss, motion for summary judgment, or motion for judgment as a matter of law, including the burden of proof and the burden of providing evidence, shall be the same as for any other civil action."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
