SENATE CONCURRENT

RESOLUTION

 

REQUESTING THE STATE DEPARTMENT OF TRANSPORTATION TO CONDUCT A STUDY REGARDING THE INABILITY OF INSULIN USERS TO OBTAIN A COMMERCIAL DRIVER'S LICENSE.

 

WHEREAS, the United States Department of Transportation (USDOT) has jurisdiction to regulate commercial drivers operating vehicles in interstate commerce throughout the United States; and

WHEREAS, current DOT rules prohibit all individuals with insulin treated diabetes from obtaining a commercial driver's license for interstate travel; and

WHEREAS, in 1993, the Federal Highway Administration embarked on a program to evaluate the safety of drivers with insulin treated diabetes; and

WHEREAS, the results of the Federal Highway Administration's study indicate that drivers with insulin treated diabetes collectively have lower accident rates than the total population of commercial vehicle drivers, and none of the accidents reviewed during the three-year survey period were attributed to a driver's diabetic condition; and

WHEREAS, in 2000 the USDOT indicated to the United States Congress that it may authorize certain drivers with insulin treated diabetes to operate commercial motor vehicles after participating in a screening process; and

WHEREAS, in the past, the Federal Government has also authorized individual states to allow persons with insulin treated diabetes to operate commercial vehicles in intrastate transportation; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-first Legislature of the State of Hawaii, the House of Representatives concurring, that the State Department of Transportation (State DOT) conduct a study regarding the inability of individuals with insulin treated diabetes to obtain a commercial driver's license; and

BE IT FURTHER RESOLVED that the State DOT's study include criteria and recommendations for authorizing individuals with insulin treated diabetes to operate commercial vehicles within the State of Hawaii; and

BE IT FURTHER RESOLVED that the State DOT report its findings and conclusions to the Legislature no later than twenty days prior to the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Transportation.
