A BILL FOR AN ACT

 

relating to STATE GOVERNMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Though our nation moves on from the terrorist attacks of September 11, 2001, the impact of that day continues to affect Hawaii's economy. The unprecedented grounding of all air travel in the United States in the days immediately after the attack and the subsequent drop in visitor arrivals effectively destroyed the momentum of Hawaii's economy. As business in hotels and restaurants plummeted in those first weeks, companies were forced to let workers go or severely reduce the number of hours worked. Many people found themselves unable to support themselves and their families. The state unemployment office was flooded with workers who lost their jobs. Providers of services to the hungry and homeless suddenly found themselves overwhelmed by requests for help. As Hawaii mourned with the rest of the nation for those lost in the attacks, we also experienced the pain of need in our own community as the damage rippled outward from the tourism industry to impact other sectors of our economy.

Faced with a $300,000,000 shortfall, the legislature finds itself in the difficult position of having to balance the budget while trying to preserve the most essential services, including those for the most vulnerable and needy of Hawaii's people. These unprecedented circumstances leave us no choice but to take unusual and, perhaps, painful steps to address the current budget shortfall and prevent further losses in education, public health, social programs, public safety, environmental protection, and investments in infrastructure for the State.

The legislature finds that it is necessary to make the best possible use of all available resources, including using funds from the inactive hurricane reserve trust fund. This fund was originally created to provide hurricane insurance coverage to Hawaii homeowners during a period when private insurance was unavailable or prohibitively expensive. Now that private insurance is readily available at reasonable prices, the fund is no longer issuing policies and the balance of the fund is unused. It is the intent of the legislature to use a portion of the moneys in the fund to prevent damage from future hurricanes, by giving matching grants to Hawaii homeowners to make their homes less vulnerable to hurricane-strength winds, and to use a portion of the fund to address other pressing and immediate needs in the state. Improving the resistance of Hawaii residences to future hurricanes will greatly decrease the potential for damage, making the kinds of losses suffered by the insurance industry in 1991 less likely. To further ensure that Hawaii is protected from future hurricanes, the legislature finds it prudent to authorize the issuance of general obligation bonds to recapitalize the relief fund and provide a back-up insurance provider for Hawaii home owners.

PART I

SECTION 2. The legislature finds that Hawaii is susceptible to property loss due to hurricanes, tropical storms, and strong winds, and that the best long-term solution to reducing the potential damage is the statewide use of wind resistive devices. The purpose of this part is establish a three-year pilot program to provide grants to certain property owners for installation of wind resistive devices that reduce the severity of property loss from strong winds.

The legislature finds that the grant program serves a public purpose by protecting the health, safety, and welfare of the residents of this State. The installation of wind resistive devices will help to reduce the incidence and severity of personal injury and property damage in the event of a hurricane, thereby preserving human life and property values and minimizing disruptions to the State’s economy, business activity, and the delivery of public services. The grant program also serves the public purpose of stimulating economic growth and activity in the State by creating business and employment opportunities through the sale and installation of wind resistive devices.

SECTION 3. (a) There is established a special fund to be designated as the loss mitigation grant fund. The fund shall consist of moneys appropriated for the purpose of the fund and all interest earned or accrued on moneys deposited in the fund.

(b) Moneys in the fund shall be expended by the insurance commissioner to administer the loss mitigation grant program under this part, including costs of marketing the program. Any law to the contrary notwithstanding, the insurance commissioner may use the moneys in the fund to employ or retain, by contract or otherwise, and without regard to chapters 76 and 78, necessary professional, expert, managerial, technical, and support personnel to implement and carry out the purposes of this part. The administration of the loss mitigation grant program and disbursements from the fund shall not be subject to chapters 42F, 91, or 103D.

(c) The insurance commissioner shall annually submit a report to the director, governor, and legislature on the use of the loss mitigation grant fund. The report shall provide statistical information on program participation. The report shall be submitted no later than twenty days prior to the convening of each regular session.

SECTION 4. (a) The insurance commissioner shall develop and implement a pilot loss mitigation grant program to encourage the installation of wind resistive devices. The insurance commissioner may, over the three years of the grant program, spend up to $15,000,000 from the loss mitigation grant fund for the grant program, which amounts shall include the costs of administering, operating, and marketing the grant program.

(b) Subject to the availability of funds and pursuant to the standards of this section, the insurance commissioner shall award grants for wind resistive devices:

(1) That reimburse fifty per cent of the costs of wind resistive devices, and of their installation and inspection, up to a maximum total reimbursement of $2,100 per dwelling;

(2) On a first-come, first-served basis; and

(3) Only for a wind resistive device or devices installed in a single or multi-family residential dwelling.

(c) Grants shall be awarded for the installation of the following types of wind resistive devices only:

(1) Uplift restraint ties at roof ridges and roof framing members to wall or beam supports;

(2) Additional fastening of roof sheathing and roof decking for high wind uplift;

(3) Impact and pressure resistant exterior opening protective devices; and

(4) Wall-to-foundation uplift restraint connection strengthening for wood foundation posts on footings.

The description of, and specifications, guidelines, and requirements for these wind resistive devices shall be further developed and determined, and may be amended, narrowed, or expanded by the insurance commissioner in the insurance commissioner’s sole discretion.

(d) A grant may be made to an applicant only if the applicant has:

(1) Met the descriptions, specifications, guidelines, and requirements established by the insurance commissioner for the grant program;

(2) Filed a completed application on forms prescribed by the insurance commissioner, together with all supporting documentation required by the insurance commissioner;

(3) In the case of a building with multiple dwellings, filed completed grant applications and supporting documentation for all dwellings in the building;

(4) Installed a wind resistive device or devices that have been approved by the insurance commissioner;

(5) Fully paid the cost of the wind resistive device or devices and the installation and inspection costs for which the grant is sought, prior to applying for the grant. The grant shall reimburse only those costs or a portion thereof;

(6) Hired an inspector, determined by the insurance commissioner to be qualified, who has verified in writing that installation of the wind resistive device or devices is complete and complies with grant program specifications, guidelines, and requirements;

(7) Installed the wind resistive device or devices after July 1, 2002; and

(8) Provided any other information and met any additional requirements deemed necessary by the insurance commissioner.

(e) As used in this part, unless the context otherwise requires:

"Wind resistive device" means a device or technique that increases the resistance of a building or other structure to damage from wind forces.

SECTION 5. There shall be no cause of action, claim for damages or relief, charge, or any other liability of any kind whatsoever created against the State, the Hawaii hurricane relief fund, the insurance commissioner, the loss mitigation grant fund or their respective agents, employees, or board, by, or relating to, the transfer of any moneys from the hurricane reserve trust fund to the loss mitigation grant fund or involving the administration and operation of the loss mitigation grant program.

SECTION 6. There is appropriated out of the hurricane reserve trust fund the sum of $5,000,000 or so much thereof as may be necessary for fiscal year 2002-2003 to be deposited into the loss mitigation grant fund.

The sum appropriated shall be expended by the Hawaii hurricane relief fund for the purposes of this part.

SECTION 7. There is appropriated out of the loss mitigation grant fund the sum of $5,000,000 or so much thereof as may be necessary for fiscal year 2002-2003 to develop and implement the loss mitigation grant program established in this part.

The sum appropriated shall be expended by the insurance commissioner for the purposes of this part.

PART II

SECTION 8. In the event of a loss due to a covered event as defined in section 431P-1, the board of directors of the Hawaii hurricane relief fund may convene and determine, in its sole discretion, whether the private insurance market is reasonably making available insurance for such covered events to consumers in the State. If the board determines that the private insurance market is not reasonably making available insurance for such covered events, the board may request that the director of finance, with the approval of the governor, commence the issuing of general obligation bonds of the State to re-capitalize the hurricane trust fund. The total amount of bonds authorized to be issued shall be $100,000,000, or so much thereof as may be necessary. The proceeds from the sale of the bonds shall be deposited into the hurricane reserve trust fund. Moneys deposited into the hurricane reserve trust fund shall be expended by the Hawaii hurricane relief fund or its authorized designee and used solely for the purposes of chapter 431P.

SECTION 9. The director of finance is authorized to issue general obligation bonds in the sum of $100,000,000 or so much thereof as may be necessary in fiscal year 2002-2003 and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2002-2003 for deposit into the hurricane reserve trust fund, provided that all appropriations made to be expended in fiscal year 2002-2003 which are unencumbered as of June 30, 2004, shall lapse as of that date. The sum appropriated shall be expended by the department of commerce and consumer affairs for the purposes of this Part.

PART III

SECTION 10. Notwithstanding any other law to the contrary, there is appropriated out of the hurricane reserve trust fund

the sum of $100,000,000 or so much thereof as may be necessary for fiscal year 2002-2003 to be deposited into the general fund.

The sum appropriated shall be expended by the Hawaii hurricane relief fund.

SECTION 11. There shall be no cause of action, claim for damages or relief, charge, or any other liability of any kind whatsoever created against the state, the Hawaii hurricane relief fund, the loss mitigation grant fund, the board of the Hawaii hurricane relief fund and its members, or their respective agents, or employees, by or relating to the transfer of any moneys from the hurricane reserve trust fund to the general fund.

PART IV

SECTION 12. There is appropriated out of the general revenues of the State of Hawaii the sum of $406,529 or so much thereof as may be necessary for fiscal year 2002-2003 to AGR 812 for seventeen positions and to maintain the measurement standards program.

The sum appropriated shall be expended by the department of agriculture for the purposes of this section.

SECTION 13. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,029,382 or so much thereof as may be necessary for fiscal year 2002-2003 to AGS 807 for the special repair and maintenance program for public school facilities.

The sum appropriated shall be expended by the department of accounting and general services for the purposes of this section.

SECTION 14. There is appropriated out of the general revenues of the State of Hawaii the sum of $454,696 or so much thereof as may be necessary for fiscal year 2002-2003 to ATG 100 for the victim witness assistance programs.

The sum appropriated shall be expended by the department of the attorney general for the purposes of this section.

SECTION 15. There is appropriated out of the general revenues of the State of Hawaii the sum of $91,460 or so much thereof as may be necessary for fiscal year 2002-2003 to ATG 100 to maintain the missing child program.

The sum appropriated shall be expended by the department of the attorney general for the purposes of this section.

SECTION 16. There is appropriated out of the general revenues of the State of Hawaii the sum of $44,376 or so much thereof as may be necessary for fiscal year 2002-2003 to ATG 231 for the criminal identification and Hawaii criminal justice data center.

The sum appropriated shall be expended by the department of the attorney general for the purposes of this section.

SECTION 17. There is appropriated out of the general revenues of the State of Hawaii the sum of $52,155 or so much thereof as may be necessary for fiscal year 2002-2003 to ATG 500 for child support enforcement.

The sum appropriated shall be expended by the department of the attorney general for the purposes of this section.

SECTION 18. There is appropriated out of the general revenues of the State of Hawaii the sum of $4,617 or so much thereof as may be necessary for fiscal year 2002-2003 to BED 103 for the land use commission.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this section.

SECTION 19. There is appropriated out of the general revenues of the State of Hawaii the sum of $63,457 or so much thereof as may be necessary for fiscal year 2002-2003 to BED 120 for energy efficiency, renewable energy, and energy emergency preparedness.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this section.

SECTION 20. There is appropriated out of the general revenues of the State of Hawaii the sum of $17,854 or so much thereof as may be necessary for fiscal year 2002-2003 to BED 144 for a planning and geographic information system.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this section.

SECTION 21. There is appropriated out of the general revenues of the State of Hawaii the sum of $339,936 or so much thereof as may be necessary for fiscal year 2002-2003 to BED 222 for rent supplement payments.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this section.

SECTION 22. There is appropriated out of the general revenues of the State of Hawaii the sum of $600,789 or so much thereof as may be necessary for fiscal year 2002-2003 to BUF 101 to maintain Bishop Museum's operational subsidy.

The sum appropriated shall be expended by the department of budget and finance for the purposes of this section.

SECTION 23. There is appropriated out of the general revenues of the State of Hawaii the sum of $402,482 or so much thereof as may be necessary for fiscal year 2002-2003 to DEF 112 for nine positions and to maintain the office of veterans' services veteran counseling program.

The sum appropriated shall be expended by the department of defense for the purposes of this section.

SECTION 24. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,077,364 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain vocational programs, including:

(1) $2,278,515 for vocational and applied technology;

(2) $95,362 for the health career academy;

(3) $311,294 for the school to work transition centers;

(4) $124,166 for the career opportunities program;

(5) $14,507 for the future homemakers of America;

(6) $15,434 for the future farmers of America;

(7) $19,040 for the vocational industrial clubs of

America;

(8) $14,815 for the distributive education club of America;

(9) $12,000 for the junior vocational industrial clubs of America;

(10) $3,332 for the industrial arts fair; and

(11) $188,899 for the Lahainaluna boarding department.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 25. There is appropriated out of the general revenues of the State of Hawaii the sum of $96,800 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for science education.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 26. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,199,008 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for curriculum development, including:

(1) $45,887 for the Hawaii content and performance standards - assessment;

(2) $132,052 for the Hawaii content and performance standards – school accountability;

(3) $747,037 for the Hawaii content and performance standards – resource development;

(4) $201,766 for other curriculum improvements;

(5) $12,713 for statewide testing; and

(6) $59,553 for instructional materials.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 27. There is appropriated out of the general revenues of the State of Hawaii the sum of $665,699 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain alternative learning programs, including:

(1) $6,902 for the Olomana youth center;

(2) $238 for Olomana hale hoomalu;

(3) $6,676 for Olomana school;

(4) $55,216 for the Maui alternative program;

(5) $19,638 for the Molokai alternative program;

(6) $31,987 for the Kauai alternative program;

(7) $40,459 for the Kona ho'oponopono;

(8) $68,318 for the Hilo hukilike;

(9) $45,088 for the Hilo high school alternative program;

(10) $86,256 for the Hawaii alternative program;

(11) $221,182 for the alternative learning center; and

(12) $83,739 for storefront school.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 28. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,357,243 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain preventative educational programs, including:

(1) $200,496 for comprehensive elementary counseling;

(2) $26,579 for the pregnant teen center - Maui;

(3) $382,017 for the pregnant/parenting program;

(4) $417,533 for the youth challenge program;

(5) $125,902 for families for real;

(6) $83,348 for lions quest; and

(7) $121,368 for in-school suspension.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 29. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,620,728 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for English as a second language learning programs.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 30. There is appropriated out of the general revenues of the State of Hawaii the sum of $61,369 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain student leadership programs, including:

(1) $24,575 for the student conference;

(2) $19,778 for the state/district student council;

(3) $4,493 for the Maui inter-school leadership council; and

(4) $12,523 for Molokai/Lanai student activities.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 31. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,620,293 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for student enrichment programs, including:

(1) $50,645 for student awards;

(2) $44,226 for the science and engineering fair;

(3) $6,000 for the sister state student exchange;

(4) $16,475 for keakealani;

(5) $47,000 for the challenger center;

(6) $79,996 for space related activities;

(7) $18,000 for the youth leadership project;

(8) $1,701,399 for the gifted and talented program;

(9) $64,610 for audiovisual centers; and

(10) $591,942 for learning centers.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 32. There is appropriated out of the general revenues of the State of Hawaii the sum of $128,060 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain art education programs, including:

(1) $3,332 for the art exhibit;

(2) $37,414 for the artmobile; and

(3) $87,314 for artists in the schools.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 33. There is appropriated out of the general revenues of the State of Hawaii the sum of $907,098 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for athletic programs, including:

(1) $20,514 for transportation for the band;

(2) $24,006 for intramurals;

(3) $542,578 for athletics; and

(4) $320,000 for girls JV sports.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 34. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,916,567 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for Hawaiian language and culture educational programs, including:

(1) $641,360 for the Hawaiian language immersion program; and

(2) $1,275,207 for Hawaiian studies.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 35. There is appropriated out of the general revenues of the State of Hawaii the sum of $747,337 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for school-based budgeting administration, including:

(1) $258,707 for unemployment insurance;

(2 $415,819 for the networking system;

(3) $20,811 for data processing; and

(4) $52,000 for the substitute system.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 36. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,126,666 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for community-based educational programs, including:

(1) $1,098,480 for the parent community networking center; and

(2) $28,186 for the Nanaikapono community/school museum.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 37. There is appropriated out of the general revenues of the State of Hawaii the sum of $9,433,388 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 to maintain kindergarten through second grade student-teacher ratios at 20 to 1.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 38. There is appropriated out of the general revenues of the State of Hawaii the sum of $113,000 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for the junior reserve officer's training corps at Waiakea and Kealakehe high schools.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 39. There is appropriated out of the general revenues of the State of Hawaii the sum of $634,719 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 100 for thirteen positions and to maintain multi-track schools.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 40. There is appropriated out of the general revenues of the State of Hawaii the sum of $228,575 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 150 for two positions and to maintain multi-track schools.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 41. There is appropriated out of the general revenues of the State of Hawaii the sum of $273,434 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 200 for instructional development and leadership programs, including:

(1) $4,990 for instructional development—administrative services;

(2) $16,478 for school renewal group;

(3) $4,519 for systems group—administration;

(4) $6,894 for accreditation/school improvement;

(5) $3,723 for educational cable channel;

(6) $35,944 for planning and evaluation;

(7) $8,508 for district resource services—English as a second language learning programs;

(8) $6,424 for district resource services—Hawaiian studies;

(9) $138,143 for teleschool;

(10) $39,869 for school improvement/community leadership group—administration; and

(11) $7,942 for leadership development.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 42. There is appropriated out of the general revenues of the State of Hawaii the sum of $7,681 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 200 for library services, including:

(1) $2,163 for school library services; and

(2) $5,518 for the school library materials processing center.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 43. There is appropriated out of the general revenues of the State of Hawaii the sum of $19,814 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 200 for teacher education, including:

(1) $6,251 for institutes and workshops--certificated;

(2) $2,086 for teacher evaluation path;

(3) $1,836 for cooperative/host teacher training; and

(4) $9,641 for teacher education—Kauai district.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 44. There is appropriated out of the general revenues of the State of Hawaii the sum of $21,263 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 200 for literacy programs, including:

(1) $4,126 for literacy; and

(2) $17,137 for NCEE-based reading program.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 45. There is appropriated out of the general revenues of the State of Hawaii the sum of $172,234 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 200 to maintain Hawaii content and performance standards, including:

(1) $164,893 for Hawaii content and performance standards—assessment; and

(2) $7,341 for Hawaii content and performance standards—training.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 46. There is appropriated out of the general revenues of the State of Hawaii the sum of $54,389 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 300 for the office of the superintendent, including:

(1) $8,906 for superintendent's office;

(2) $300 for the protocol fund;

(3) $2,997 for business/education partnerships;

(4) $33,405 for internal audit;

(5) $2,397 for PBRD—administration of the office of information technology;

(6) $2,397 for public affairs—administration of the office of human resources;

(7) $3,301 for budget; and

(8) $686 for civil rights compliance office.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 47. There is appropriated out of the general revenues of the State of Hawaii the sum of $732,432 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 300 for statewide administration, including:

(1) $5,355 for collective bargaining administration;

(2) $92,232 for administrative/business services;

(3) $5,520 for facilities and support services;

(4) $11,051 for personnel services;

(5) $341 for service and merit awards;

(6) $4,219 for equal employment/opportunity affirmative action;

(7) $81,222 for criminal history record check;

(8) $14,448 for personnel recruitment;

(9) $17,978 for blood pathogen control;

(10) $42,985 for school administrator training program;

(11) $50,720 for reprographic services;

(12) $6,283 for duplicative services;

(13) $6,718 for office of information and technology—general;

(14) $53,739 for information resource management;

(15) $8,400 for network support services;

(16) $39,789 for information systems services;

(17) $75,700 for financial management services; and

(18) $215,732 for comprehensive human resource systems.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 48. There is appropriated out of the general revenues of the State of Hawaii the sum of $43,112 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 300 for district administration and curriculum, including:

(1) $4,950 for administration Honolulu district;

(2) $2,001 for curriculum Honolulu;

(3) $9,895 for administration central district;

(4) $2,107 for curriculum central;

(5) $5,430 for administration leeward district;

(6) $1,268 for curriculum leeward;

(7) $2,678 for administration windward district;

(8) $1,275 for curriculum windward;

(9) $2,974 for administration Hawaii district;

(10) $3,778 for curriculum Hawaii;

(11) $3,981 for administration Maui district;

(12) $1,358 for curriculum Maui;

(13) $1,026 for administration Kauai district; and

(14) $391 for curriculum Kauai.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 49. There is appropriated out of the general revenues of the State of Hawaii the sum of $259,202 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 400 for state administration, including:

(1) $4,221 for state administration;

(2 $697 for state administration services;

(3) $154,320 for telecommunications charges for schools;

(4) $1,756 for school inspection; and

(5) $98,208 for auxiliary services—Oahu.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 50. There is appropriated out of the general revenues of the State of Hawaii the sum of $13,522 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 400 for food services.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 51. There is appropriated out of the general revenues of the State of Hawaii the sum of $56,361 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 400 for the disposal of hazardous materials within the department of education.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 52. There is appropriated out of the general revenues of the State of Hawaii the sum of $128,930 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 400 for multi-track schools.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 53. There is appropriated out of the general revenues of the State of Hawaii the sum of $636,755 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 407 for fifteen various permanent positions, bookmobile services, student hires, and to maintain current hours of operation.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 54. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,640,034 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 407 to maintain operation of six community libraries, including:

(1) $272,336 for Aiea;

(2) $269,132 for Aina Haina;

(3) $300,764 for Liliha;

(4) $287,524 for Manoa;

(5) $203,768 for Wahiawa; and

(6) $306,510 for Hawaii Kai.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 55. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,178,978 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 500 for other statewide and school level administration, including:

(1) $47,808 for state administration services; and

(2) $2,131,170 for school level administration.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 56. There is appropriated out of the general revenues of the State of Hawaii the sum of $467,915 or so much thereof as may be necessary for fiscal year 2002-2003 to EDN 500 for the afterschool (A+) program.

The sum appropriated shall be expended by the department of education for the purposes of this section.

SECTION 57. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,200,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HMS 204 to maintain general assistance payments at current level.

The sum appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 58. There is appropriated out of the general revenues of the State of Hawaii the sum of $421,161 or so much thereof as may be necessary for fiscal year 2002-2003 to HMS 301 to maintain grant in aid for "blueprint for change."

The sum appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 59. There is appropriated out of the general revenues of the State of Hawaii the sum of $242,499 or so much thereof as may be necessary for fiscal year 2002-2003 to HMS 301 to maintain grant in aid for "parents and children together."

The sum appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 60. There is appropriated out of the general revenues of the State of Hawaii the sum of $300,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HMS 302 to maintain grant in aid for "good beginnings alliance."

The sum appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 61. There is appropriated out of the general revenues of the State of Hawaii the sum of $90,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HMS 603 for grant in aid for "hale mahaolu" for home and community-based service for disabled individuals.

The sum appropriated shall be expended by the department of human services for the purposes of this section.

SECTION 62. There is appropriated out of the general revenues of the State of Hawaii the sum of $128,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HRD 102 to maintain the resource for employee assistance and counseling help (REACH) program.

The sum appropriated shall be expended by the department of human resources development for the purposes of this section.

SECTION 63. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,150,635 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 101 to maintain the tuberculosis control program.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 64. There is appropriated out of the general revenues of the State of Hawaii the sum of $5,343,236 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 121 to maintain STD/AIDS prevention services.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 65. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,240,232 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 131 to maintain epidemiology services.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 66. There is appropriated out of the general revenues of the State of Hawaii the sum of $149,500 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 141 to operate the Maui dental clinic.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 67. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,192,698 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 440 to maintain case management and substance abuse services to those in the criminal justice system.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 68. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,509,245 or so much thereof as may be necessary for fiscal year 2002-2003 to JUD 310 for fifty-nine positions and (4) rural courthouses, including:

(1) $713,765 for Ewa district court;

(2) $830,486 for Koolaupoko/Kaneohe district court;

(3) $377,438 for Waianae district court;

(4) $587,556 for Wahiawa district court; and

The sum appropriated shall be expended by the judiciary for the purposes of this section.

SECTION 69. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,315,914 or so much thereof as may be necessary for fiscal year 2002-2003 to JUD 310 for purchase of service contracts, including:

(1) Emergency shelter services;

(2) Domestic violence services;

(3) Substance abuse services for juveniles;

(4) Sex offender treatment services; and

(5) Shelter and residential services for adults and juveniles.

The sum appropriated shall be expended by the judiciary for the purposes of this section.

SECTION 70. There is appropriated out of the general revenues of the State of Hawaii the sum of $112,563 or so much thereof as may be necessary for fiscal year 2002-2003 to LBR 111 for three positions and to maintain the apprenticeship program in the workforce development division.

The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this section.

SECTION 71. There is appropriated out of the general revenues of the State of Hawaii the sum of $112,567 or so much thereof as may be necessary for fiscal year 2002-2003 to LBR 143 for three positions and to maintain the Hawaii occupational safety and health program.

The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this section.

SECTION 72. There is appropriated out of the general revenues of the State of Hawaii the sum of $112,558 or so much thereof as may be necessary for fiscal year 2002-2003 to LBR 153 for 2.5 positions for the civil rights commission.

The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this section.

SECTION 73. There is appropriated out of the general revenues of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2002-2003 to LBR 903 to maintain purchase of services contracts for the office of community services.

The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this section.

SECTION 74. There is appropriated out of the general revenues of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2002-2003 to LNR 806 for Mookini Luakini state park.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this section.

SECTION 75. There is appropriated out of the general revenues of the State of Hawaii the sum of $60,844 or so much thereof as may be necessary for fiscal year 2002-2003 to LNR 806 to keep the entire sand island state park open.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this section.

SECTION 76. There is appropriated out of the general revenues of the State of Hawaii the sum of $69,711 or so much thereof as may be necessary for fiscal year 2002-2003 to LNR 806 for all state parks including Polihale, Wailea, Malaekahana, and Boiling Pots.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this section.

SECTION 77. There is appropriated out of the general revenues of the State of Hawaii the sum of $146,925 or so much thereof as may be necessary for fiscal year 2002-2003 to LTG 105 for five positions and to maintain the office of information practices.

The sum appropriated shall be expended by the office of the lieutenant governor for the purposes of this section.

SECTION 78. There is appropriated out of the general revenues of the State of Hawaii the sum of $172,207 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 420 to maintain substance abuse treatment services for neighbor island facilities.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 79. There is appropriated out of the general revenues of the State of Hawaii the sum of $179,113 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 501 for seven positions for security at Waimano home hospital.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 80. There is appropriated out of the general revenues of the State of Hawaii the sum of $250,895 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 501 for twelve positions and to maintain perimeter security at the State's mental health hospital in Kaneohe.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 81. There is appropriated out of the general revenues of the State of Hawaii the sum of $174,808 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 501 for 9.5 positions and to maintain State library security.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 82. There is appropriated out of the general revenues of the State of Hawaii the sum of $497,828 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 501 to maintain the State library security contract.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 83. There is appropriated out of the general revenues of the State of Hawaii the sum of $84,489 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 501 for four positions and to maintain security for department of defense facilities in the Diamond Head region.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 84. There is appropriated out of the general revenues of the State of Hawaii the sum of $217,090 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 612 to maintain treatment services and job development for parolees on the neighbor islands.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 85. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,628,000 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 900 for lease of eighty federal detention center beds.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 86. There is appropriated out of the general revenues of the State of Hawaii the sum of $7,325,201 or so much thereof as may be necessary for fiscal year 2002-2003 to PSD 900 for four hundred fifty-five out-of-state prison beds.

The sum appropriated shall be expended by the department of public safety for the purposes of this section.

SECTION 87. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,450,000 or so much thereof as may be necessary for fiscal year 2002-2003 to SUB 601 to subsidize rural hospital operations, including:

(1) $750,000 for Hana community health center; and

(2) $700,000 for Molokai general.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 88. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,085,000 or so much thereof as may be necessary for fiscal year 2002-2003 to SUB 601 to subsidize rural hospital operations, including:

(1) $735,000 for Waianae district comprehensive health and hospital board; and

(2) $350,000 for Kahuku hospital.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 89. There is appropriated out of the general revenues of the State of Hawaii the sum of $5,242,200 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 100 to maintain current funding level for the University of Hawaii at Manoa.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 90. There is appropriated out of the general revenues of the State of Hawaii the sum of $564,236 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 210 to maintain current funding level for the University of Hawaii at Hilo.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 91. There is appropriated out of the general revenues of the State of Hawaii the sum of $15,713 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 220 to maintain current funding level for small business development.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 92. There is appropriated out of the general revenues of the State of Hawaii the sum of $76,039 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 700 to maintain current funding level for the University of Hawaii, West Oahu.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 93. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,077,649 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 800 to maintain current funding level for the University of Hawaii community colleges.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 94. There is appropriated out of the general revenues of the State of Hawaii the sum of $12,507 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 881 to maintain current funding level for the University of Hawaii aquarium.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 95. There is appropriated out of the general revenues of the State of Hawaii the sum of $594,959 or so much thereof as may be necessary for fiscal year 2002-2003 to UOH 900 to maintain current funding level for the University of Hawaii system-wide administration.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this section.

SECTION 96. There is appropriated out of the general revenues of the State of Hawaii the sum of $250,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 595 to provide a grant-in-aid to wahiawa general hospital.

The sum appropriated shall be expended by the department of health for the purposes of this section.

SECTION 97. There is appropriated out of the general revenues of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2002-2003 to HTH 730 to provide additional ambulance services for Kula on the island of Maui.

The sum appropriated shall be expended by the department of health for the purposes of this section.

PART V

SECTION 98. The director of finance is authorized to issue general obligation bonds in the following sums, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2002-2003 for the following purposes:

1. Kapolei high school, Oahu

Construction and equipment for the fourth increment, phase IIB.

Construction $13,000,000

Equipment $ 500,000

Total funding $13,500,000

2. Mililani Mauka II elementary school, Oahu

Construction and equipment for first and/or second increment, phase IIB.

SECTION 99. The sums appropriated for the respective capital projects set forth in section 98 shall be expended by the department of accounting and general services for the purposes of this Part.

SECTION 100. The director of finance is authorized to issue general obligation bonds in the following sums, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2002-2003 for the following purposes:

1. Waimanalo wastewater treatment plant improvements, Oahu

Construction for incremental improvements, including injection wells, backwash filter structure and filter cells, chlorine mixing and contact chamber, dissolved air flotation thickener, clarifiers, pump station, flood proofing, equalization basin system upgrades, and other related work.

SECTION 101. The sums appropriated for the respective capital projects set forth in section 100 shall be expended by the department of land and natural resources for the purposes of this Part.

SECTION 102. The appropriations made for the capital improvement projects authorized by this Part shall not lapse at the end of the fiscal year for which the appropriations are made; provided that all moneys from the appropriations unencumbered as of June 30, 2005, shall lapse as of that date.

SECTION 103. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,200,000 or so much thereof as may be necessary for fiscal year 2002-2003 to BUF 115 to provide for the additional debt service attributable to the capital improvement projects authorized by this Part.

The sum appropriated shall be expended by the department of budget and finance for the purposes of this section.

PART VI

SECTION 104. This Act shall take effect on July 1, 2002; provided that sections 2 through 4 shall be repealed on June 30, 2005.
