A BILL FOR AN ACT

 

MAKING AN APPROPRIATION FOR SERVICES TO low-income INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The departments of health and human services provide innovative programs and services to Hawaii's exceptional children and a large segment of Hawaii's individual's with disabilities. These programs and services are provided through various channels including Felix-focused programs, dynamic nursing services via the Medicaid waiver program, general assistance programs, and other programs and services.

However, the legislature finds that there exists a substantial segment of the population that is developmentally disabled and in need of services that do not qualify for any of the programs and services currently being offered by the State. These individuals with developmental disabilities receive a monthly income amount, usually from the Social Security Administration, that disqualifies them from receiving Medicaid services and other state services unless they relinquish part of their income. However, the income received, although greater than the Medicaid and state program thresholds, is too low to pay for needed medical and therapy services and general sustenance necessities. Therefore, these low-income individuals with developmental disabilities do not receive the health, medical, and therapy services they need.

The purpose of this Act is to appropriate funds to provide programs and services for low-income individuals with developmental disabilities who are not Medicaid recipients.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2002-2003, for programs and services for low-income individuals with developmental disabilities who are not Medicaid recipients.

SECTION 3. The sum appropriated shall be expended by the department of health for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2002.
