A BILL FOR AN ACT

 

RELATING TO PROCUREMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is a need to increase public access to procurement information.

Currently, if a government agency initiates a request for proposals or invitation for bids for a printed item, such as an environmental impact statement or other lengthy report, the report will usually be submitted to the agency in printed form. There is no provision in the public procurement code that requires the agency to obtain an electronic copy of such a report, nor is the winning bidder obligated to produce an electronic copy.

The legislature finds that requiring the submission of an electronic copy in addition to a printed copy will greatly increase the potential for public access to these procured documents. Lengthy documents that have been procured by a public agency, once that agency makes the document available on-line or if it can be transmitted by email, for example, will reduce public costs associated with photocopying, mailing, and employee time spent in making photocopies, and, if necessary, binding lengthy documents.

Accordingly, the purpose of this Act is to amend the public procurement code to require that any procured item that can be submitted in printed form must also be submitted in an electronically produced copy, in addition to the printed copy.

SECTION 2. Section 103D-105, Hawaii Revised Statutes, is amended to read as follows:

"§103D-105 Public access to procurement information. (a) Notwithstanding any law to the contrary, in order to increase the potential for greater public access to procurement information, any item that has been procured pursuant to this chapter that can be submitted in printed form shall be submitted in an electronically produced copy, in addition to a printed copy. The transmittal of an electronically produced copy under this section shall be made through an electronic transmitting device that is compatible with the receiving device of the governmental body requesting the information, including computer diskette, magnetic tape, email, posting on an Internet website, or other appropriate electronic means that meets the specifications provided by rules of the governmental body.

(b) Government records relating to procurement shall be available to the public as provided in chapter 92F. Part I of chapter 92 shall not apply to discussions, deliberations, or decisions required to be conducted or made confidentially under this chapter."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2002.
