A BILL FOR AN ACT

 

relating to school complexes.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-   Student transfers due to overcrowded schools within school complexes. If the department determines that redistricting is required due to overcrowding in a school, causing a student to transfer to another school within the same school complex or another school complex, the department shall:

(1) Mail a notice of the redistricting and the transfer of the student, including the name of the school to which the student will be transferred, to the parent of the student, not less than nine months in advance of the date of the transfer, to allow the parent to adequately plan in advance for the transfer of the student; and

(2) Hold a public hearing on the redistricting and transfer, not less than nine months in advance of the date of the transfer, to obtain public input from the parents of the affected students."

SECTION 2. The department of education shall postpone until July 1, 2002, the implementation of the current redistricting plan for the school complex that includes Mauka Lani elementary school and Makakilo elementary school.

All residents within the Mauka Lani elementary school district as of December 31, 2000, shall be allowed to remain as part of the district boundary for the Mauka Lani elementary school. Residents moving into the Mauka Lani elementary school district subsequent to December 31, 2000, may be assigned to appropriate schools as determined by the department of education, without regard to this section.

All residents within the Makakilo elementary school district as of December 31, 2000, shall be allowed to remain as part of the district boundary for the Makakilo elementary school. Residents moving into the Makakilo elementary school district subsequent to December 31, 2000, may be assigned to appropriate schools as determined by the department of education, without regard to this section.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $1 or so much thereof as may be necessary for fiscal year 2001-2002 for one full-time equivalent (1.00 FTE) security guard position to be assigned to Barbers Point elementary school.

The sum appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2001.
