A BILL FOR AN ACT

 

RELATING TO EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-    Open enrollment. (a) All school-aged persons shall have the right to attend the public school of their choice, subject only to rules adopted by a receiving school or by the department for receiving schools to resolve situations where the number of applicants exceeds the number of available spaces at the receiving school.

(b) The rules shall not be subject to the public hearing and public notice requirements of chapter 91.

(c) The department shall assist in the placement of school-aged persons who are unable to attend their home school because the number of applicants exceeds the number of available spaces at their home school.

(d) For the purposes of this section:

"Home school" means a public school within the geographic attendance area of a school-aged person's legal residence.

"Receiving school" means a public school outside the geographic area of a school-aged person's legal residence."

SECTION 2. Section 302A-1143, Hawaii Revised Statutes, is repealed.

["[§302A-1143] Attend school in what district. All persons of school age shall be required to attend the school of the district in which they reside, unless it appears to the department to be desirable to allow the attendance of pupils at a school in some other district, in which case the department may grant this permission."]

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
