A BILL FOR AN ACT

 

relating to defining "swimming pool" to exempt pools with natural ocean circulation systems.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§321- Definitions. Whenever used in this section, the following terms shall have the following meanings:

"Natural ocean circulation system" means a system using natural coastal flow, such as waves, tides, and currents as a means of exchanging bodies of water to and from its system.

"Swimming pool" or "pool" means any structure, basin, or reservoir containing an artificial body of water intended for swimming, diving, or recreational bathing or therapy. "Swimming pool" does not include any pool using a natural ocean circulation system."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2002, provided that if the department of health shall have adopted administrative rules concerning pools using a natural ocean circulation system prior to July 1, 2002, this Act shall not take effect and provided further that if this Act takes effect, this Act shall be repealed upon the adoption by the department of health of administrative rules concerning pools using a natural ocean circulation system.
