A BILL FOR AN ACT

 

RELATING TO ELECTRONIC TRANSACTIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 489E-2, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""Electronic certification" means a process whereby an unalterable electronic symbol, mark, or sound is attached to an electronic copy of a record as an official attestation that the electronic copy of the record is a true copy of the original record in the custody of the officer to whose custody the original record is entrusted."

SECTION 2. Section 489E-11, Hawaii Revised Statutes, is amended to read as follows:

"[[]§489E-11[]] Notarization [and], certification, acknowledgment[.], and verification. If a law requires a signature or record to be notarized, certified, acknowledged, verified, or made under oath[,] or seal, the requirement is satisfied if the electronic signature or electronic certification of the person authorized to perform those acts, together with all other information required to be included by other applicable law, is attached to or logically associated with the signature or record."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
