A BILL FOR AN ACT

 

relating to Rehiring Retired Teachers in the Department of Education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Act 308, Session Laws of Hawaii 2001, is amended by amending section 2 to read as follows:

"SECTION 2. Beginning July 1, 2001, the department of education may employ retired teachers at up to one hundred per cent full-time equivalents in teacher shortage areas identified by the department of education and to serve as mentors for new classroom teachers with the prior approval of the superintendent of education, and pursuant to collective bargaining agreements. The provisions of sections 88-21, 88-42.5, 88-43, 88-45, and 88-46, Hawaii Revised Statutes, and any other statute to the contrary notwithstanding, retired teachers who are hired under this section shall not earn retirement service credit, contribute to the retirement system, or gain additional retirement system benefits as a result of their employment; provided that the retired teachers shall continue to receive entitled normal retirement benefits without penalty. To qualify for full-time employment, the teacher shall be retired for [two] at least one calendar [years.] year. A retired teacher may qualify for mentoring immediately upon retirement."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon approval.
