A BILL FOR AN ACT

 

relating to abortion.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 577A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§577A- Mifepristone use; parental consent. (a) The drug mifepristone or RU486 shall not be sold to a minor under the age of sixteen years without the consent of one of the minor's parents or the minor's legal guardian. The department of health shall provide by rule pursuant to chapter 91 for implementation of this section.

(b) If the minor's parent or legal guardian refuses to give consent, or if the minor elects not to seek the consent of a parent or guardian, the minor may petition the family court for a waiver of the parental consent requirement of this section.

(c) The knowing, intentional, or reckless sale of mifepristone to a minor who is younger than sixteen years of age without the consent of one of the minor's parents or the minor's legal guardian, is a misdemeanor."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4. This Act shall take effect upon its approval.
