A BILL FOR AN ACT

 

RELATING TO DRIVERS LICENSES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the imposition of the requirement that applicants for drivers licenses under the age of eighteen complete a driver education program and a behind-the-wheel driver training course was imposed without regard for possible inefficiencies in providing these programs. The purpose of this Act is to provide the authority to waive these requirements for a temporary period of time so that the responsible agencies can address the problem of efficiently and affordably providing the driver education program and behind-the-wheel driver training course to the many applicants desiring them.

SECTION 2. Section 286-108, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"§286-108 Examination of applicants.

(b) The examiner of drivers shall require proof from every applicant under the age of eighteen that the applicant has completed a driver education program and a behind-the-wheel driver training course certified by the director of transportation. For a period of one year from the effective date of this act, the department of transportation and the examiner of drivers may waive the driver education program and behind-the-wheel driver training course requirements for applicants under the age of eighteen. The examiner of drivers shall not examine any applicant for a driver's license who is sixteen through seventeen years of age unless the applicant holds a valid instruction permit under section 286-110, for a period of no fewer than ninety days."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2001; provided that on June 30, 2002, section 2 of this Act shall be repealed and section 286-108(b), Hawaii Revised Statutes, is reenacted in the form in which it read on the day before the approval of this Act.
