A BILL FOR AN ACT

 

rELATING TO GOVERNMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 103D-1003, Hawaii Revised Statutes, is amended to read as follows:

"§103D-1003 Printing, binding, advertising, and stationery work. (a) All bids submitted for a printing, binding, or stationery section 103D-302 contract in which all work will be performed in-state, including all preparatory work, presswork, bindery work, and any other production-related work, to include storage and shipping costs, shall receive a fifteen per cent preference for purposes of bid evaluation.

(b) A bidder for printing and advertising services shall file a sworn statement with the department of labor and industrial relations, in a form and manner as prescribed by the director of labor and industrial relations, that the services to be performed shall be:

(1) Performed by employees paid the prevailing rate of compensation for persons employed in similar public employment, or if the prevailing rate does not exist, the employees are paid no less than the minimum wage as provided in section 387-2; and

(2) In compliance with all applicable laws of the federal and state governments relating to workers' compensation, unemployment compensation, payment of wages, and safety.

[(b)] (c) Where bids are for work performed in-state and out-of-state, then for the purpose of selecting the lowest bid submitted only, the amount bid for work performed out-of-state shall be increased by fifteen per cent. The lowest total bid, taking the preference into consideration, shall be awarded the contract unless the solicitation provides for additional award criteria. The contract amount awarded, however, shall be the amount of the price offered, exclusive of the preference.

(d) All printing and advertising for which the State is charged and which is paid for with public funds shall be performed in-state; provided that this shall not apply to printing for primary public school districts.

(e) Any person who intentionally violates subsection (b) shall be fined $500 for the initial and each subsequent offense."

SECTION 2. Statutory material to be repealed is bracketed. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
