A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the State is obligated under the Felix v. Cayetano consent decree to improve services to special education students that also require mental health services. The Felix management and accountability study recommends a change in the formula of allocating regular education students so that each special education student counts as one whole regular education student.

The purpose of this Act is to appropriate funds and create the necessary positions to implement this recommendation.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $1 or so much thereof as may be necessary for fiscal year 2001-2002 for the establishment of permanent teacher positions in the department of education.

The sum appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 3. This Act shall take effect on July 1, 2001.
