HOUSE CONCURRENT

RESOLUTION

 

requesting the departmentS OF AGRICULTURE AND land and natural resources to address the disrepair of kailua reservoir.

 

 

WHEREAS, Kailua reservoir was originally built as part of a sugar irrigation system, and served as a flood detention and sediment retention basin in years past; and

WHEREAS, when properly maintained, Kailua reservoir functions as a basin to catch debris, preventing downstream culverts from clogging and protecting the surrounding area from flooding; and

WHEREAS, Kailua reservoir is in a state of disrepair; and

WHEREAS, one important part of the Kailua reservoir, the overflow control valve, has not been properly maintained and is in a state of disrepair; and

WHEREAS, the disrepair of the overflow control valve leads to flooding during periods of heavy rain, causing real and personal property damages to private property owners near the Kailua reservoir; and

WHEREAS, the continued failure of the State to properly maintain the Kailua reservoir exposes adjoining landowners and residents to significant and possibly mortal danger, and exposes the State to massive liability; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the Senate concurring, that the Department of Agriculture is requested to repair and properly maintain Kailua reservoir; and

BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to work in tandem with the Department of Agriculture, and all community stake-holders, and use every means and resource at its disposal to repair and properly maintain Kailua reservoir, and is further requested to contract with a private individual or entity, or with a community-based organization, to maintain and repair the reservoir; and

BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to submit a report of actions taken with regard to the repair and maintenance of Kailua reservoir to the Legislature no later than twenty days before the convening of the regular session of 2002; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the Director of the Department of Agriculture, and to the Board of Land and Natural Resources.
