Description:

Expands the exemption from Public Utilities Commission regulations to include public utilities owned and not operated by the State or its political subdivisions, provided that the State or its political subdivisions shall not use fees generated by the operation of utilities owned but not operated by the State or its political subdivisions for general funded operations or non-utility related expenses or projects.

A BILL FOR AN ACT

 

RELATING TO PUBLIC UTILITIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 269-31, Hawaii Revised Statutes, is amended to read as follows:

"§269-31 Application of this chapter. This chapter shall not apply to commerce with foreign nations, or commerce with the several states of the United States, except insofar as the same may be permitted under the Constitution and laws of the United States; nor shall it apply to public utilities owned and not operated by the State, or any county, or other political subdivision[.]; provided that the State or a political subdivision shall not use fees generated by the utility operation for general funded operations or non-utility related expenses or projects."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
