A BILL FOR AN ACT

 

RELATING TO PUBLIC SAFETY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that deputy sheriffs serve subpoenas and other court processes. Any person can masquerade as a deputy sheriff unless an identification badge is worn. The legislature believes that deputy sheriffs should be conspicuously identified.

The purpose of this Act is to require deputy sheriffs to wear identification badges and to carry wallet identifications.

SECTION 2. Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§353C- Deputy sheriffs; identification badges. (a) Every deputy sheriff shall wear an identification badge at all times while on duty, including while serving official documents under chapter 607. The badges shall have the name and photograph of the deputy sheriff, the designation "Deputy Sheriff", the words "State of Hawaii", and the seal of the State of Hawaii. The badges shall be worn on the chest and be of a size that makes it clear and visible.

(b) Every deputy sheriff shall carry a wallet size identification card with the same photograph and information as specified under subsection (a). The identification card shall be carried at the same time as the badge is worn."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
