A BILL FOR AN ACT

 

relating to the public employees health fund.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 87-11, Hawaii Revised Statutes, is amended to read as follows:

"§87-11 Composition of board. (a) The board of trustees shall consist of [nine trustees, three of whom shall be representatives from different organizations representing public employees, three from different private business organizations, a member of the clergy, a teacher, and the director of finance or a designated representative.] an equal number of public employee and public employer representatives. The members shall consist of:

(1) Representing public employee organizations:

(A) One representative from each of the organizations certified as an exclusive representative for government employees;

(B) One retiree of the employees’ retirement system to be elected by the members of the employees' retirement system under rules adopted by the board of trustees of the employees' retirement system governing the election. The retiree member shall serve for a term of six years to expire on January 1 of the sixth year; provided that, if after the close of filing of petitions for candidacy, a member is unopposed for election to a trustee position, the member shall be deemed and declared to be duly and legally elected to the position of trustee without an election; and

(2) Representing public employers:

(A) Two representatives from the State appointed by the governor;

(B) One representative from the judiciary nominated by the chief justice; and

(C) One representative from each of the four counties nominated by the mayors of the respective counties.

If the number of public employee organizations changes, and there is a need for a reduction or increase in the number of public employer representatives, the public employer representatives listed above shall determine which jurisdiction representatives shall be deleted or added."

SECTION 2. Section 87-13, Hawaii Revised Statutes, is amended to read as follows:

"§87-13 Term of a trustee; vacancy. [Except for the director of finance, the] The term of office of [each trustee] the retiree member shall be [four] six years. The [director of finance] respective public employer and public employee organization representatives shall serve [during the director's term of office as director of finance.] at the discretion of the chief executive or public employee organization director.

A vacancy of the retiree member position on the board of trustees shall be filled by appointment of the governor[.] if fewer than two years remain of the retiree's term. If two or more years remain, a new election shall be held to fill the vacancy. The person appointed to fill a vacancy shall serve for the remainder of the term of the person's predecessor.

If by the end of the trustee's term a trustee is not reappointed or the trustee's successor is not appointed, the trustee shall serve until the trustee's successor is appointed."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on January 1, 2002.
