A BILL FOR AN ACT

 

RELATING TO AGRICULTURE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. By Act 206, Session Laws of Hawaii (SLH) 2000, the legislature extended the lapsing date of funds originally appropriated by Act 117, SLH 1999, to June 30, 2001. However, the funds have not been fully utilized for their original intent of planning, design, and construction of an agricultural subdivision in the Hamakua district on the island of Hawaii. Therefore, the legislature finds it necessary to deposit any unexpended or unencumbered funds at the close of fiscal year 2000-2001 into the Hawaii agricultural development revolving fund, which will allow the agribusiness development corporation to expend any unencumbered funds without having to request a new appropriation or extension.

The purpose of this Act is to allow for the deposit of any unexpended or unencumbered funds at the close of fiscal year 2000-2001 that was appropriated under Act 206, SLH 2000, into the Hawaii agricultural development revolving fund.

SECTION 2. Act 117, Session Laws of Hawaii 1999, as amended by Act 206, Session Laws of Hawaii 2000, is amended by amending section 4 to read as follows:

"SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $400,000 or so much thereof as may be necessary for fiscal year 1999-2000 for the expenses incurred in the performance of the duties of the agribusiness development corporation board; provided that:

(1) Any unexpended or unencumbered funds at the close of fiscal year 1999-2000 may be expended or encumbered during fiscal year 2000-2001, [and shall not lapse until June 30, 2001; and] and any unexpended or unencumbered funds at the close of fiscal year 2000-2001 shall be deposited into the Hawaii agricultural development revolving fund; and

(2) The agribusiness development corporation may use $250,000 for grants for the development of an agricultural subdivision in the Hamakua district on the island of Hawaii.

The sum appropriated shall be expended by the department of agriculture for the purposes of this Act."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on June 29, 2001.
