                   A  BILL  FOR  AN  ACT

RELATING TO SPECIAL PURPOSE REVENUE BONDS FOR MEDICAL WASTE
   FACILITY PROJECT DEVELOPMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that it is in the public
 
 2 interest to encourage the development of facilities for the safe
 
 3 and proper disposal of various waste streams including medical
 
 4 waste.  The legislature further finds that HEED, Inc., a Hawaii
 
 5 corporation, is engaged in the development on Oahu and Molokai of
 
 6 a plasma waste conversion facility for the safe and proper
 
 7 disposal of medical waste and thereby serves the public.
 
 8      The legislature further finds that HEED, Inc., may be
 
 9 assisted through the issuance of special purpose revenue bonds
 
10 because it is an industrial enterprise pursuant to part V,
 
11 chapter 39A, Hawaii Revised Statutes, and the financing thereof
 
12 is assistance to an industrial enterprise.
 
13      The legislature finds and declares that the issuance of
 
14 special purpose revenue bonds under this Act is in the public
 
15 interest and for the public health, safety, and general welfare.
 
16      SECTION 2.  The legislature finds and determines that the
 
17 activity and facility of HEED, Inc., constitute an industrial
 
18 enterprise as defined in part V, chapter 39A, Hawaii Revised
 
19 Statutes.  Pursuant to part V, chapter 39A, Hawaii Revised

 1 Statutes, the department of budget and finance, with the approval
 
 2 of the governor, is authorized to issue in one or more series
 
 3 special purpose revenue bonds in a total amount not to exceed
 
 4 $5,000,000, for the express purpose of assisting HEED, Inc., in
 
 5 the establishment of a plasma waste conversion facility for the
 
 6 disposal of various waste streams including medical waste.
 
 7      (1)  Prior to the issuance of any permit for the plasma
 
 8           waste conversion facility, an informational briefing
 
 9           shall be held to inform the citizenry of all aspects of
 
10           the facility's operations;
 
11      (2)  That informational briefing shall be followed by a
 
12           public hearing to garner as much additional input as
 
13           possible;
 
14      (3)  The department of health shall cite the language
 
15           embodied in this Act within the body of any permits
 
16           issued for plasma waste conversion of various waste
 
17           streams including medical waste so that the
 
18           legislature's conditions and limitations are not
 
19           separated from the permit or permits, and, in addition,
 
20           shall ensure that those conditions and limitations set
 
21           forth by the legislature extend throughout the life of
 
22           the facility; and
 
23      (4)  This facility shall be available to members of the

 1           public, including hospitals, medical clinics,
 
 2           laboratories, and other health care providers serving
 
 3           the public.
 
 4      SECTION 3.  The special purpose revenue bonds issued under
 
 5 this Act shall be issued pursuant to part V, chapter 39A, Hawaii
 
 6 Revised Statutes, relating to the authority to issue special
 
 7 purpose revenues bonds to assist industrial enterprises.
 
 8      SECTION 4.  The authorization to issue special purpose
 
 9 revenue bonds under this Act shall lapse on December 31, 2004.
 
10      SECTION 5.  This Act shall take effect on July 1, 1999.
